Welcome to Evolforms, an application from Codedesign SpA designed to provide digital form solutions to our business clients. Thank you for your interest in our services. Before you start using Evolforms, please read and understand the following Terms of Service (Terms). These Terms constitute a legally binding agreement between you (Client) and Codedesign SpA (Codedesign, we, us, or our). By accessing or using Evolforms, you agree to comply with these Terms.
1. Service Description
Evolforms is a digital form application that allows clients to create, manage, and complete custom forms. The service includes a web environment for administration and a mobile application, currently available only for Android devices. Completed forms can be sent via email with PDF and photo attachments, integration with HTTP POST through a web service that receives JSON files, and the ability to integrate with Google Drive to store PDFs and photos. We do not use Google data and user accounts are only accessed to save data from the Evolforms app, such as PDFs, images, and Google Sheets spreadsheets. Under no circumstances will data in Google be accessed by Codedesign staff or any user other than the account owner.
2. Account Creation
To use Evolforms, you must obtain at least one license, which can be used to create a user account. You are responsible for maintaining the confidentiality of your login credentials and are responsible for all activities that occur under your account. User licenses are billed monthly in advance.
3. Responsibility of the Client
Evolforms provides tools for clients to create and manage their own forms. The Client is solely responsible for the data submitted through the application. Neither Evolforms nor Codedesign assumes any responsibility for the accuracy, completeness, or legality of the information contained in the forms created and submitted by the Client.
4. Data Storage
Evolforms will store the data submitted through the forms for a maximum period of 60 days. It is the Client's responsibility to back up this data before the retention period expires. After 60 days, the submitted form data will be irreversibly deleted and there will be no possibility of recovery.
5. Data Submission Methods
Form data can be submitted via email with attachments, HTTP POST integration, and storage in Google Drive. Codedesign strives to ensure the security of these transmissions, but is not responsible for the security of data during the transmission process.
6. Intellectual Property
All intellectual property rights in Evolforms, including copyrights, trademarks, and trade secrets, are owned by Codedesign. The Client has no right to reproduce, copy, distribute, or use in any way the Evolforms software, design, or content without the express written authorization of Codedesign.
7. Updates and Modifications
Codedesign reserves the right to update, modify, or change these Terms at any time. You will be notified of any material changes to the Terms, and your continued use of Evolforms after such modifications will constitute your acceptance of the new Terms.
In the To the maximum extent permitted by applicable law, Codedesign and Evolforms shall not be liable for any direct, indirect, incidental, special or consequential damages, including, but not limited to, loss of profits, data, use or any other intangible loss, resulting from the use of or inability to use Evolforms.

Codedesign reserves the right to suspend or terminate your access to Evolforms at any time and for any reason, including breach of these Terms. In the event of termination, your data may be permanently deleted.
10. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the place of incorporation of Codedesign SpA, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms shall be resolved exclusively in the competent courts of the relevant jurisdiction.

By using Evolforms, the Client accepts and acknowledges having read, understood, and accepted all the terms and conditions set forth in this document.
